FAQ

When must my employer pay my FnF?

Under the Code on Wages (in force from November 2025), wages due on termination or resignation must be settled within two working days of the last working day. Many companies still quote "30–45 days" — that no longer holds for wage components.

Am I eligible for gratuity?

After 5 years of continuous service (courts have held 4 years + 240 days qualifies). The formula: (basic + DA) × 15/26 × completed years, with 6+ months rounding up to a full year. Tax-free up to ₹20 lakh.

How is leave encashment calculated?

Most employers pay (basic + DA) ÷ 30 per day of unused earned leave; some use ÷26 or full gross — check your policy. On resignation, leave encashment up to ₹25 lakh is tax-exempt for non-government employees (lifetime limit).

Can my employer deduct for short notice?

Yes, if your contract says so — typically (gross or basic) ÷ 30 × shortfall days. It's set off against your FnF. Many companies waive it if you help transition; get any waiver in writing.

What if my employer just doesn't pay?

Send a written demand (keep proof), then escalate to the labour commissioner of your state — the process is low-cost and doesn't need a lawyer for wage claims.
