Take a Gurgaon employee on a basic salary of ₹65,000 a month with ₹32,500 of HRA, renting a 2 BHK at ₹40,500 a month — figures drawn from this city’s mainstream rental bands. Section 10(13A) exempts the least of three amounts:

This is what the mistake costs. Someone in Gurgaon who ticks “metro” would compute the third limb as ₹3,90,000 instead of ₹3,12,000 and claim ₹3,90,000 instead of ₹3,12,000 — ₹78,000 of income wrongly treated as exempt. Payroll usually catches it in the February TDS true-up, and the whole shortfall is recovered from one month's salary.

How much rent do you need to use your whole HRA?

Keeping the same ₹65,000 basic and ₹32,500 HRA, and moving only the rent through Gurgaon’s own bands, the binding limb changes:

At the bottom of the range your exemption is throttled by limb two — the 10% of basic that is deducted from your rent before anything is exempt. Higher up, the 40% ceiling takes over, and paying more rent stops buying you any further exemption. Renting above that point is a lifestyle decision, not a tax one.

Renting in Gurgaon: what is different here

Gurgaon's rental stock is dominated by condominium societies, and the price gradient runs along the Golf Course Road and its Extension. DLF Phases 1 to 5 carry the established premium tenancies, Sohna Road and the Southern Peripheral Road offer newer towers at lower rents, and the older sectors give the best value at the cost of amenity. Fully furnished lettings are far more common here than in most Indian cities, and they carry both a rent premium and a larger deposit.

Deposit convention. 2–3 months' rent, often higher in the condominium belt.

Agreement and registration. The Haryana Rent (Regulation) framework and standard 11-month agreements apply. Society-managed condominiums usually require the agreement plus police verification before issuing a resident pass — that paperwork doubles as excellent HRA proof.

The Gurgaon catch. Gurgaon is NOT a metro for HRA. It is in the National Capital Region, it is not in Delhi, and Rule 2A names four cities only. A Gurgaon employee on ₹1,00,000 basic who claims the 50% limb overstates the third limb by ₹1,20,000 a year — and it is the employer's TDS that gets corrected first.

Who is claiming HRA in Gurgaon

Gurgaon has the densest concentration of multinational corporate offices, consulting firms and global capability centres in the country. Their salary structures are usually national templates with HRA at 50% of basic regardless of posting — which is precisely how Gurgaon employees end up being handed metro-rate HRA while sitting on the 40% exemption limb. Yes, once the annual rent exceeds ₹1,00,000 — about ₹8,333 a month. In Gurgaon that threshold is crossed by almost every letting, including 1 BHKs. If the landlord will not share a PAN, they must give a declaration in Form 60, and many employers reject the claim without one.

No. Your employer's salary structure and the Income Tax Rules are unrelated. A company can pay HRA at any percentage it likes anywhere in the country, and most large employers use one national template. Rule 2A independently caps the exempt amount at 40% of basic plus DA outside the four metros. Being paid metro-rate HRA in Gurgaon simply means more of that HRA is taxable.
