Gujarat rewrote its professional tax scale in 2022, collapsing a fiddly multi-band table into a single threshold. It is now among the simplest in the country — but the collecting authority is not always the one employers expect.

The law that applies in Gujarat
Professional tax in Gujarat is levied under the Gujarat State Tax on Professions, Trades, Callings and Employments Act, 1976, administered by the Gujarat Commercial Tax Department, with collection through local authorities. Article 276 of the Constitution caps what any state may charge a person under this head at ₹2,500 a year, which is why no slab anywhere in India exceeds that figure.
Who must register in Gujarat
Employers register and deduct from staff; self-employed persons enrol and pay directly. What makes Gujarat distinctive is that professional tax is administered in coordination with local authorities — municipal corporations, municipalities and panchayats — so the office you deal with depends on where your establishment sits.
An employer with premises in more than one municipal area should confirm which authority each is registered with rather than assuming a single statewide filing.
When it must be paid
Employers remit monthly, by the 15th of the following month. Smaller employers may be placed on a less frequent cycle by the collecting authority, so check the conditions on your certificate.
The 2022 simplification
Before April 2022 Gujarat ran a graded table with several bands beginning around ₹6,000 a month. From 1 April 2022 that was replaced with a single rule: nothing up to ₹12,000, ₹200 a month above it.
The revision took a large number of lower-paid employees out of the net entirely. Payroll still running the pre-2022 bands will be deducting ₹80 or ₹150 from people who now owe nothing at all — small sums individually, but wrong, and visible on every payslip.
Who is exempt in Gujarat
- Anyone earning ₹12,000 a month or less — the threshold set in the 2022 revision.
- Senior citizens.
- Persons with a physical disability and parents of a child with a disability.
If you pay late
Interest applies to late remittance, and the collecting authority may levy a penalty for failure to register. Because collection runs through local bodies, notices arrive from the municipal authority rather than a central state office.
How it affects your income tax
Professional tax paid is fully deductible from salary income under Section 16(iii) of the Income-tax Act, in both the old and the new regime. Your employer normally accounts for it when computing TDS, so it reduces taxable salary rather than being claimed separately. If you are enrolled and pay directly, keep the challans — the deduction is still available to you.
